DISABILITY INFORMATION
Have you applied and been denied disability benefits? Disability cases can be challenging to navigate. The Social Security Administration is underfunded, understaffed and seriously backlogged with cases to review. Most cases are denied for lack of evidence due to applicants not knowing how to present their particular situation in such a way that describes accurately how they meet the requirements for a winning case.
Ruberte Law is comprised of a team of professionals who have not only worked for the Social Security Administration hearings offices in the past, but who have also managed clients just like you in private firm settings. Additionally, we are strong community advocates for disability rights, access to healthcare and individual dignity that everyone deserves. If you are unable to work because of a disability (physical, mental or both), contact Ruberte Law today for a FREE, no obligation consultation.
SOCIAL SECURITY DISABILITY INSURANCE BENEFITS
Social Security Disability Insurance is a program that is taxpayer funded, meaning that workers that earn a paycheck and their employer takes taxes out, a portion of these tax dollars are withheld for people who have become or are already disabled and unable to engage in substantial, gainful activity from regular, consistent employment.
Being in this position and unable to work puts these people at a disadvantage in being able to provide for themselves and/or their family. These individuals should apply for Social Security Disability Insurance. These benefits will not be automatic and the government will not simply send a monthly check. Also, a person’s disability must be expected to last at least one year, or result in death, in order to receive the taxpayer funded disability benefits.
If you have worked long enough and paid taxes into the Social Security program for a specified duration of time, then you should be able to take part in these benefits if you’ve truly become disabled and unable to perform a job you were once capable of. There is a specific formula and table used to calculate your age, when you became disabled, and how long you will need to have worked and paid taxes into the program in order to qualify.
SUPPLEMENTAL SECURITY INCOME
Supplemental Security Income may be available to children or adults who are disabled, blind, or age 65 or older with limited income and/or resources. It is a financial needs based program that is intended for disabled individuals with limited household financial resources. If you do not meet these requirements personally, but you have a child that is either blind or disabled, your child may qualify for SSI. Just like with Social Security Disability Insurance, each potential recipient of Supplemental Security Income must meet specific work, disability and needs-based standards, and that may vary depending on their situation.
By applying and being approved to receive SSI benefits to help cover the costs of basic needs such as food, clothing and shelter, there’s a likely chance that other government benefits would also be available, such as the Supplemental Nutrition Assistance Program (SNAP) and Medicaid.
